Dignity Health v. Mounts (2024) 105 Cal.App.5th 113. An orthopedic surgeon filed a cross-complaint against a hospital alleging that the hospital had retaliated against him for complaining about the quality of patient care and thereby interfered with prospective economic opportunities and engaged in unlawful business practices. The Court held that the orthopedic surgeon had not demonstrated the probability of prevailing because the hospital’s actions were subject to the litigation privilege, and the causes of action alleged against the hospital were thereby barred by the SLAPP statute. The hospital was also awarded its attorney’s fees and costs.
